I received the downpayment credit back to my credit card on 27 May.  The credit card company credited back the international transaction fee as well.

I also received information from the PROFECO representative as follows:
According to the following article, there is a term of 5 working days to cancel the contract without penalization. 

Article 56 of the Federal Consumer Protection Law states: &quot;The contract will be perfected within five working days from the delivery of, or the signature of the contract, which ever occurs the latest.  During this period, the consumer will have the right to revoke his consent without any responsibility.  The revocation will have to be by means of warning or delivery of notice, in person, by registered mail, or another method of average reliability.  The revocation according to this article, will terminate the contract.  In this case, the costs of shipping and insurance will be the responsibility of the consumer.  If the contract is for services, this article will not be applicable if the date of receipt of the service is less than ten working days from the date of the order of purchase.&quot; 

Besides, this right can not be waived according to the Art. 1 from the Federal Consumer Protection Law.  

You must send your cancellation request by mail to all the Mexican addresses in the contract, since It is every important that you keep the evidence in written of the cancellation notice within the allowed term, it means, return receipt requested.

You may follow up with e-mails and/or faxes however they may not be considered as a method of average reliability and the normal time frame to get a response and / or refund from the company is around 20 days. 

We cannot intercede until this term pass; in the meantime, you may contact your credit card company and dispute the charges if you paid by credit card.

We inform you that Profeco does not cancel contract but we offer help in case that the company does not fulfill your contract or does not honor your cancellation request. 

For additional information or help, do not hesitate to contact us again, or if you do not received your cancellation / money back within the term above mentioned you may file a formal complaint with us. Please keep us informed.

		<description>I just wanted to let you know that the information that you posted here to get out of the timeshare was VERY valuable to me in recovering my money from PB Sunset. 

I received confirmation that the monies will be refunded in 15 days from the Director of Member Services.  We&#039;ll see if it happens.  I am also requesting for confirmation of contract cancellation.

It is very important to send your emails with a delivery and read receipt notice since the sales people will not respond to your inquiries.  Also very important to copy (cc:) PROFECO on all email correspondence.

Good luck to all who have encountered this problem.  One of life&#039;s very valuable lessons.

		<description>I will tell you some of our experience.  Anyone who purchases or desires to purchase a timeshare in Mexico needs to know about PERFECO.  These folks are feared by Mexican timeshare sellers, as PERFECO is run by the government.  If you need to get out of a Mexican timeshare within the 5 business days of signing, they are the ones to contact. We bought at the Mayan Palace located between Cancun and Playa.  What a mistake.  All lies.  High pressure.  Totally misleading on what we were buying. We actually went to PERFECO&#039;s office located in downtown Cancun and had them stamp a seal or our request letter to cancel the contract addressed to the Mayan Palace where we bought 3 days before. The folks at PERFECO also called the Mayan Palace and told them we at the PERFECO office and were heading that way to cancel.  We also emailed the resort that we were coming with a letter sealed by PERFECO and expected no trouble in canceling.  We got a ride to the Mayan Palace and presented the letter.  They immediately had me sign a letter saying the contract was canceled and the matter was closed.  Our down payment was refunded within 12 days.  No questions asked.  Without that stamp from PERFECO, we were informed later by the people where we were staying (The Royal Cancun), that we would not have a had a chance in getting anything done.  We ended up buying at The Royal Cancun.  Fabulous place. All inclusive, no hard sale. Best service you will find.  Gourmet restaurants on sight plus wonderful buffet. Right on the Caribbean.  All room are ocean view.  Open bars everywhere.  No one allowed under 16.  If you are interested in purchasing a Mexican timeshare.  I would recommend The Royal Cancun or The Royal Playa Del Carmen.  The sales staff are honest forthright and extremely helpful.  And..you will absolutely get what you pay for.

Two days later I personally talked with a manager and told them I wanted to cancel, gave them my book etc.  Manager said ok. I have been around the block many many times on this situation that it kills me to think about it. For those who look at this site and think any timeshare might be a mistake, I wouldn&#039;t agree. What I would suggest is that you never make such a significant purchase on an impulse.
For those not familiar, almost every hotel and many of the restaurants in Cabo are connected with timeshares, and you will be offered free food and activities for taking a tour. They pressure you to attend, but think about it - if you have problems saying no to this, how are you going to hold up to the high pressure sales pitch?
Take your time, do your research. If you get home and decide that you really wish you would have bought a time share, there is a large resale market, or bets that you could work with their sales group.
